These Terms of Service ("Terms") govern your access to and use of CampaignMorph (the "Platform" or "Services") operated by [Your Legal Entity Name], located in Mumbai, India ("we", "us", "our"). By accessing or using the Services (including free no-login tools or freemium features), you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or older if required in your jurisdiction) to use the Services. If under the age of majority, you need parent/guardian consent.
2. Accounts
- Free tools: No account required.
- Freemium tools: You must create an account with accurate information. You are responsible for maintaining password security. We may suspend/terminate accounts for violations.
3. Free vs. Freemium Services
- Free tools: Limited features, no login, temporary processing (files deleted after use).
- Freemium tools: Require login; free tier has limits (e.g., watermarks, file size, usage quotas); paid upgrades remove limits and add features.
4. User Content and Licenses
You retain ownership of content you upload ("User Content"). By uploading, you grant us a worldwide, non-exclusive, royalty-free license to:
- Use, host, store, reproduce, modify (for formatting/processing), display, and distribute your content solely to provide the Services.
- Use anonymized/aggregated data for improving tools and analytics.
You represent that your content does not infringe third-party rights and complies with laws.
5. Acceptable Use
You agree not to:
- Upload illegal, harmful, infringing, or abusive content.
- Reverse engineer, scrape, or attempt to extract source code.
- Overload servers or use for spam/commercial resale.
- Use automated tools to access without permission.
We may remove content or suspend access for violations.
6. Intellectual Property
The Platform, tools, designs, and output formats (excluding your User Content) are owned by us or licensors. You receive a limited, non-transferable license to use the Services as intended during your subscription/use.
7. Payments and Subscriptions
Paid plans are billed monthly/annually via our payment processors. Prices may change with notice. No refunds except as required by law. Free tier may change or be discontinued.
8. Termination
We may suspend or terminate access for any reason (with or without cause/notice). You may stop using the Services anytime.
9. Disclaimers and Limitation of Liability
Services provided "as is" without warranties. We are not liable for indirect, consequential, or punitive damages. Maximum liability is limited to fees paid in the last 12 months (or ₹10,000 if free user).
10. Indemnification
You agree to indemnify us against claims arising from your User Content or misuse.
11. Governing Law and Disputes
These Terms are governed by the laws of India. Disputes shall be resolved in courts of Mumbai, Maharashtra.
12. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance.
